SIGNIFICANT CHANGES TO THE AMC PRIVACY POLICY - 9/2/04

In the Welcome Section

In the second paragraph, added:

This privacy policy applies only to information collected online.

In the fourth paragraph, added:

In addition, special programs being operated by AMC business and websites, such as co-branded promotions and sweepstakes, may also be governed by different privacy practices.

In Section 1

Added "Credit information AMC Collects":

We may collect your financial information such as credit and debit card numbers and bank and other financial institution account numbers in connection with transactions you enter into with AMC. We use your financial information to help us perform these transactions and to deliver the goods and services you have requested. We may use third party service providers to help us perform some of these tasks. In such instances, we will provide your financial information to these third parties for the sole purpose of performing these tasks. We may also provide your financial information to your credit card issuer, financial institutions or credit card processors to process transactions. We will not be responsible or otherwise liable for any use or disclosure of your financial information by a third party to whom AMC is allowed to disclose your financial information under this privacy policy.

In Section 3

In "Merger or Transfer of Interest," added:

Your information will be treated as an asset and transferred in the event of a sale or transfer of AMC, i.e. your information may be passed on to a third party in the event of a transfer of ownership, or assets, or bankruptcy of AMC.

In Section 7

Changed first sentence from:

We use your personal information only for the reasons for which you provided it.

To:

We use your personal information only for the reasons consistent with this privacy policy.

Added sentence to last paragraph:

Please note that changing information or otherwise opting-out of receipt of communications from us and third parties will only change the data for purposes of future communications and transactions.

In Section 8

Changed second paragraph from:

If we use personal information from a child that is 12 years old or younger, we use that child's information only to enroll him or her in one of our programs (such as MovieWatcher or our Read for the Stars programs), send weekly newsletters, or enter him or her into a contest or promotion.

To:

Unless you tell us otherwise, AMC will only use the personal information for the purpose the information was provided. For instance, when a child registers for our Read for the Stars program, we will collect only their email address and use it for the sole purpose of sending them information about the Read for the Stars program.

In paragraph three, changes the last sentence from:

We also do not encourage children 12 years old or younger to share more personal information than is needed to participate in an AMC activity, such as by offering them a special game, prize, or other activity.

In Section 9

Changed last sentence of first paragraph from:

If we materially change our information practices or this Privacy Policy in such a way that your personal information may be used or shared in a different manner, we will take reasonable measures to notify you of these changes in advance to give you the choice to opt-out of having your personal information used or shared in that new manner.
